If a weekend of cleaning and a coat of paint is all that stands between the property and a normal listing, listing is the better choice and the seller keeps the difference.
A creative structure, such as subject-to
Where the loan balance is close to or above what the property is worth, a conventional sale can leave the seller owing money at closing. In a subject-to purchase we take over responsibility for the payments and the existing loan stays in place. The seller must understand that the loan stays in their name and does not transfer, so their credit remains exposed; anyone who tells them otherwise is not being straight with them. Sellers who have real equity should not use this structure — a conventional sale is cleaner and pays them.
